The most common situation is that of a step-parent, or other family member, adopting a child that has been in their legal custody for some time. While it is ideal if the birth parent consents to the adoption process, there are situations where their consent is not needed.
For example, if the biological parent has had no significant contact with their child for over a year without substantial justification, the court could find their consent to be unnecessary. Similarly, parental consent to adopt may not be needed if the biological parent has failed to provide financial support for their child in excess of one year.
